Welcome to the Cross Creek Club Homeowners Association. Cross Creek is a golf course community located in both Silver Spring and Beltsville, Maryland.

The Cross Creek Club H.O.A. consists of a seven member Board of Directors as well as several Committees. For additional information on the Board of Directors, or one of the Association's Committee's, click on the tabs on the top of this page.

SPECIAL MEETING of the OWNERS - July 19, 2018

A special meeting of the Association was held on Thursday, July 19, 2018 at the Laurel Branch Library in Laurel, MD. The meeting began at 7:00 p.m. and was led by Mr. William Lee, the Association's President who spoke about the recent closure of the Cross Creek Golf Club. A summary of Mr. Lee’s presentation is itemized below.

WHAT WE KNOW:

• Cross Creek Golf Club is owned by CVC USA Corporation, a Delaware Corporation. The
property contains an 18 hole public golf course, golf clubhouse, parking lot, a shared
maintenance/bathhouse building, a 25 meter pool and two doubles tennis courts.

• The President of the corporation is John Chung, a resident of Korea, and the corporation
Secretary is Don Chung, a brother, who lives in Howard County.

• In the early part of 2018 CVC apparently made a decision to suspend all operations and
abandon its maintenance obligations, without providing any notice or informing the HOA.

• After learning of CVC’s abandonment, the HOA contacted CVC’s insurance agent and found
that insurance policies that were to run thru June of 2018 had been cancelled effective
January 31, 2018.

• CVC also appears to have removed funds from the Recreation Reserve account it was
maintaining for improvements to the Golf Club owned recreation facilities.

• A lender, Woori America Bank, provided a $2,000,000 loan to CVC in February of 2013.
The lender holds a Deed of Trust along with an Assignment of Leases and Rents for the
Golf Club property. In May of 2018, the lender filed a complaint in the Prince George’s
County Circuit Court for breach of contract

• The HOA has begun to exercise its rights under the Declaration of Covenants. A 30 day
default letter regarding the tall grass growing on the course was mailed to CVC on June
8th, and the Association’s Board feels that the HOA is now in a position to have a
contractor begin mowing. The Covenants permit the HOA to seek repayment from CVC for
any mowing expenses.

• The Board has authorized the law firm representing the HOA, McMillan Metro, P.C., to
prepare and send a more compressive default notice to CVC. That notice contained
references to the Recreation Reserve funds as well as CVC’s failure to operate and maintain
the pool, tennis courts and the golf course, and was sent July 6, 2018.

• Prior to the start of the development of Cross Creek Club, Preliminary Plans were prepared
and approved in both Prince George’s and Montgomery County. The plans were based on
underlying residential zoning, R-R in Prince George’s and R-200 in Montgomery, and the golf
course was approved using a Recreational Overlay in Prince George’s and a Special Exception
in Montgomery. These provisions permitted the developer to plat lots smaller than 20,000 sf
and created the open space parcels that were used to build the golf course.

• The golf course parcels contain numerous streams, wetlands and stormwater management
ponds along with the golf course. There are numerous Category I Tree Conservation
Easements in favor of the MNCPPC recorded on a majority of the wooded areas that serve as
buffers from the residential lots.

• The roads bordering the golf course are private and owned by the Association as are
numerous common area parcels, some of which contain portions of the golf course paths.

• Any redevelopment of the golf course property in Prince George’s County would likely
involve some type of zoning change. It is unclear if similar action would be required in
Montgomery County to remove the Special Exception.

• The MNCPPC would have to agree to extinguish the recorded Type I Conservation Easements.

• The 9 SWM ponds are all located on the course and serve both the course and the residential
development. The ponds are covered by easements in favor of the county in which they are
located.

WHAT WE DO NOT KNOW:

• What, if any, plans CVC has regarding the golf course.
• What, if any, assets that CVC owns besides the golf course.
• How the litigation between CVC and its Lender will progress. CVC has apparently been
served with process but has not filed an Answer. The case has a “try by” date of
September 3, 2019, but there is no guaranty a trial will occur.
• The whereabouts of the Replacement Reserve funds that were held under the terms of the
Golf Course Declaration in the name of CVC at Woori America Bank.
• What, if any, plans the Lender has for the property, including potentially foreclosure.
• If there is any interest from either county in purchasing the golf course.

Until further Notice All Cross Creek Club Meetings will be held at the Conference Room of the Beltsville Branch Library.

THE COVENANTS COMMITTEE MEETING AS WELL AS THE NEIGHBORHOOD WATCH MEETING SCHEDULED FOR 7:00 PM HAVE BEEN MOVED TO THE CONFERENCE ROOM OF THE BELTSVILLE LIBRARY. THE LIBRARY IS LOCATED AT 4319 SELLMAN ROAD IN BELTSVILLE.

FOLLOW POWDER MILL ROAD TO A TRAFFIC LIGHT AT RHODE ISLAND AVE. TURN RIGHT AT RHODE ISLAND AVE. AND FOLLOW RHODE ISLAND AVE. TO A 4 WAY STOP SIGN AT SELLMAN ROAD. TURN RIGHT ON SELLMAN RD AND FOLLOW IT TO THE LIBRARY ON THE LEFT.
